Customer is fully aware and acknowledges that although the Products and Services are operational and available to at least 99.9% of the time, there is still a portion of the Products and Services, for various and multiple reasons, that may not be provided free and clear of interruptions and underperformance, at all times.
USING OUR SERVICES
You must follow any policies made available to you within the Services. Don't misuse our Services. For example, don't interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms & conditions or policies or if we are investigating suspected misconduct.
Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don't remove, obscure, or alter any legal notices displayed in or along with our Services.
Our Services display some content that is not CSETMail. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don't assume that we do.
In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.

We will send a courtesy email informing you to back up your information ino order to transition to a new version 1 out of BETA. Any costs incurred are non refundable. You account will be transfered over to the Version 1 however it will not have your data. Once again please back up your emails and or information. During the transition to the new version may take up to 180 days. Thank you for being a part of the BETA and we look forward to a bug free Version with enhanced features.

You need a CSETMail Account in order to use our Services. You can create a CSETMail Account on the homepage of csetmail.com or request vi contact field. To protect your CSETMail Account, keep your password confidential. You are responsible for the activity that happens on or through your CSETMail Account. Try not to reuse your CSETMail Account password on third-party applications.
PRIVACY AND COPYRIGHT PROTECTION
CSETMail privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that CSETMail can use such data in accordance with our privacy policies.
BUYING MORE SPACE
Billing - You can increase your storage space (Currently Disabled) to your account in your user PROFILE tab. We'll automatically bill you from the date you upgrade your space and on each periodic renewal until cancellation. You are responsible for all applicable taxes, and we will charge tax when required to do so.
No Refunds - You may cancel your extra space at any time but you will not be issued a refund. Please note that it may take up to 24 hours for your new storage to become available.
AUTO-RENEW YOUR ACCOUNT
You may cancel your service at any time but you won't be issued a refund. All data and information will be deleted within 30 days. Your Account will remain in effect until it expires or is renewed. We will send you an automated email 30 days prior to your account expiring. If you do not renew your Account within those 30 days, service and all data will be deleted without further notice. (NOTE: 60 day window to re-new).
Changes. We may change the fees in effect without notice.
We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in the Copyright Act.
YOUR CONTENT IN OUR SERVICES
ABOUT SOFTWARE IN OUR SERVICES
When a Service requires or includes downloadable software, this software may update automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings.
CSET gives you a personal, worldwide, non-assignable and non-exclusive license to use the software provided to you by CSET as part of the Services. There is a fee associated with these rights and can be changed at any time by CSET Tech. inc. Currently there is a 12 month license fee and a 24 month license fee. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by CSET, in the manner permitted by these terms. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
Open source software is important to us. Some software used in our Services may be offered under an open source license that we will make available to you. There may be provisions in the open source license that expressly override some of these terms.
MODIFYING AND TERMINATING OUR SERVICES
We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.
You can stop using our Services at any time, although we'll be sorry to see you go. CSET Tech. Inc. may also stop providing Services to you, or add or create new limits to our Services at any time.
We believe that you own your data and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to get information out of that Service.
OUR WARRANTIES AND DISCLAIMERS
We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we don't promise about our Services.
Other than as expressly set out in these terms or additional terms, neither CSET Tech. Inc. or its suppliers or distributors make any specific promises about the Services. For example, we don't make any commitments about the content within the Services, the specific functions of the Services, or their reliability, availability, or ability to meet your needs. We provide the Services "as is".
Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.
LIABILITY FOR OUR SERVICES
When permitted by law, CSET, and CSET's suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.
To the extent permitted by law, the total liability of CSET, and its suppliers and distributors, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services (or, if we choose, to supplying you the Services again).
In all cases, CSET Tech. Inc., and its suppliers and distributors, will not be liable for any loss or damage that is not reasonably foreseeable.
We recognize that in some countries, you might have legal rights as a consumer. If you are using the Services for a personal purpose, then nothing in these terms or any additional terms limits any consumer legal rights which may not be waived by contract.
BUSINESS USES OF OUR SERVICES
If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify CSET Tech. Inc. and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees.

We strive to keep the Services up and running however, all online services suffer occasional disruptions and outages. CSET is and shall not be liable for any disruption or loss you may suffer as a result of CSET service disruption of any kind.
CSET, OUR PRINCIPALS, PARTNERS, ASSOCIATES, AFFILIATES, RESELLERS, DISTRIBUTORS, AND VENDORS, MAKE NO WARRANTIES, GUARANTEES OR CONDITIONS, EXPRESS OR IMPLIED, WITH RESPECT TO THE USE OF CSETMail AND RELATED SERVICES.
YOU UNDERSTAND THAT USE OF THE SERVICES IS SOLELY AT YOUR OWN RISK AND THAT WE PROVIDE THE SERVICES ON AN AS IS BASIS WITH ALL FAULTS AND AS AVAILABLE.
YOU ACKNOWLEDGE THAT COMPUTER AND TELECOMMUNICATIONS SYSTEMS AREN'T FAULT-FREE AND OCCASIONAL PERIODS OF DOWNTIME OCCUR. CSETMail DOES NOT GUARANTEE OR PROVIDE ANY ASSURANCE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OR THAT CONTENT OR DATA OR COMMUNICATION LOSS WILL NOT OCCUR.
LIMITATION OF LIABILITY
If CSET breaches this Agreement, or is found at fault under any court of law and under any jurisdiction world wide, you hereby irrevocably agree that your exclusive remedy is to recover, from CSET or any affiliates, resellers, distributors, or vendors, direct damages up to an amount equal to your trailing months service/subscription fee to CSET. You hereby waive any and all rights to recovery of any damages or losses of any kind including without limitation direct, consequential, loss of profits special, indirect, incidental, punitive or any other. These limitations and exclusions apply even where and in the event that this remedy does not fully compensate you for any losses, or fails in its essential purpose, or in the event that CSET knew or should have known about the possibility of the damages. To the maximum extent permitted by law, these limitations and exclusions apply to anything related to this Agreement including but not limited to loss of Content, failure to communicate, loss of business, any virus affecting your use of the services; delays or failures in starting or completing transmissions or transactions, claims for breach of contract, warranty, guarantee, or condition, strict liability, negligence; misrepresentation or omission, trespass, violation of statute, law or regulation, or unjust enrichment.
This Agreement shall be governed by the laws of Canada.
You and we irrevocably consent to the exclusive jurisdiction and venue of the courts in Canada for all disputes arising out of or relating to this Agreement or the Services provided by CSET.
ABOUT THESE TERMS
We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We'll post notice of modifications to these terms on this page. We'll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.
If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.
These terms control the relationship between CSET and you. They do not create any third party beneficiary rights.
If you do not comply with these terms, and we don't take action right away, this doesn't mean that we are giving up any rights that we may have (such as taking action in the future).
If it turns out that a particular term is not enforceable, this will not affect any other terms.
The courts in some countries will not apply to Canadian law to some types of disputes. If you reside in one of those countries, then Canadian law is excluded from applying. Your country's laws will apply to such disputes related to these terms. Otherwise, you agree that the laws of Canada, will apply to any disputes arising out of or relating to these terms or the Services. Similarly, if the courts in your country will not permit you to consent to the jurisdiction and venue of the courts in Canada, then your local jurisdiction and venue will apply to such disputes related to these terms. Otherwise, all claims arising out of or relating to these terms or the services will be litigated exclusively in the federal or provincial courts of Canada, and you and Cset Tech. Inc. consent to personal jurisdiction in these courts.

FORWARD DISABLE- Sender of the email can control whether or not the recipient can forward the email to a 3rd party (Applies to CSETMail Users only) Option: (Sender can utilize Self Destruct for external email services EG: Gmail, Yahoo, etc.)
*ICON SIGNATURE - Logs a Date, Time & Icon on the sender and the reciever´s user interface increasing security and notification of provable and controllable re-distribution if desired or required to do so legally and through any form of media including but not limited to Printing, Copying, Forwarding, or as simply as replying.
PLEASE NOTE: ICON SIGNATURES ARE LOCATED ON THE RIGHT SIDE OF THE USER INTERFACE WITHIN THE EMAIL CLIENT. PLEASE TAKE SOME TIME TO BECOME FAMILIAR WITH THESE ICONS AS THEY WILL MAKE FOR A BETTER USER EXPERIENCE. The Icon Signatures are default (faded) and when enabled they will (highlight dark) as a visual notification. Please hover over each Icon for a Tool Tip.
REPLY DISABLE - Sender can remove the recipient’s ability to reply (Applies to CSETMail Users only) Option: (Sender can utilize Self Destruct for external email services EG: Gmail, Yahoo, etc.)
ENCRYPTION - We encrypt all the information you send over CSETMail. Our dedicated servers have built-in Encryption and have the most up to date, standards of security providing you a level of data security in your email service in both sending and receiving and where email interception will not be possible.
TIME LIMIT READ - This features enables the user to control the time the recipient will have to read or access the email. The time limit feature ranges from 1 minute to 30 days. There is a count down clock signifying on the receivers inbox. Once the sender pre set time limit is reached, the receiver will no longer have the ability to read or access the email. PLEASE NOTE: TIME LIMIT READ CAN ONLY BE APPLIED TO ONE EMAIL ADDRESS. The Timer on receiver side will trigger upon opening of email.
COPY DISABLE - The sender can control whether or not the recipient can right click information of email content and can copy the content into a different email or document.
SELF DESTRUCT EMAIL - When the self-destruct feature is applied to a sent email the recipient will only be able to view the content once. After closing the message it will automatically self-destruct and no longer be available to view. The sender may choose if the receiver has the privilege of knowing that it will Self Destruct by a Yes or No option. PLEASE NOTE: SELF DESTRUCT CAN ONLY BE APPLIED TO ONE EMAIL ADDRESS PER INSTANCE.
OBSCURE PRINT - Once enabled, in the event an email recipient attempts to print your message, the content will be completely obscured preventing hard copies of the message being created.
RECALL EMAIL - INFORMATION OR DATA SENT TO AN IN-CORRECT CSETMail USER ADDRESS, CAN BE DELETED. YOU MAY ALSO DELETE A NON CSETMail ( EG: GMAIL, YAHOO), ADDRESS PROVIDED YOU APPLIED AT LEAST ONE SECURITY FEATURE BEFORE SENT. WITH THE EXCEPTION OF ´ TIME DELAY SEND ´
PASSWORD PROTECT - With the enabled PASSWORD PROTECTED feature, the sender controls not the receiver of the email, but the viewer.
